  1. This is an agreement between you and Surfware, Inc. By accepting, you agree to these terms. If you do
  2. not agree, return the materials to us to receive a full refund. We grant you a non-exclusive license to use
  3. the computer software and related documentation on a single computer to demonstrate the use of the
  4. software. The software is protected by U.S. Copyright law and all right, title, and interest in and to the
  5. software, including intellectual property rights, remains with us. You agree not to translate, reverse 
  6. engineer, modify, disassemble or decompile the software.

  8. THE SOFTWARE IS PROVIDED "AS-IS" WITHOUT WARRANTY OF ANY KIND. WE SPECIFICALLY
  9. DISCLAIM ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT 
  10. LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR 
  11. PURPOSE, AND INFRINGEMENT.

  13. We shall not be liable for any indirect, incidental, special, consequential, or exemplary damages or lost 
  14. profits, arising out of the use or inability to use the software even if we were advised of the possibility
  15. of such damages. In no case shall our aggregate liability exceed $100 or the license fees paid to us 
  16. hereunder, whichever is greater.
